This Privacy Notice applies to the APC SmartConnect Service. It supplements the\r\n Schneider Electric Data Privacy and\r\n Cookie Policy. It explains what personal information will be collected by SmartConnect through Your use of the\r\n Service\r\n and accessing the SmartConnect site, how the information will be used, and\r\n how You can control the collection, correction and/or deletion of information. Capitalized terms used but not defined\r\n in this Notice have the meaning given to them in the\r\n SmartConnect Terms of Use.

Schneider Electric IT Limited is part of the Schneider Electric group which is a \r\n global organization that commits to ensure an adequate level of protection for personal information in compliance with applicable laws.

SmartConnect is an optional Service based on a Cloud platform that, after activating the user account, permits to\r\n remotely display information about the user's registered UPS devices, obtain tailored information/notifications and\r\n take action on the device. Using SmartConnect is the preferred way to work with the device, because it enables these\r\n additional functions; however, it is possible to operate in an offline way and without using SmartConnect and without\r\n using these functions. In its efforts to protect personal information, American Power Conversion Corporation (A.P.C.) and its parent company, Schneider Electric, have adopted\r\n internal policies which impose common rules for the collection, use and disclosure of personal information by all\r\n Schneider Electric entities globally and aim at ensuring the protection of personal information within the Company. 1. What personal information do we process?

\r\n

We process the following personal information:

1.1. Information that You provide to us directly

\r\n

This is information You provide when you register and when You contact or communicate with us. This includes\r\n information about your identity & contact, your Schneider Electric account ID, your professional life (company,\r\n professional field) and the devices you register in SmartConnect. This also includes information you provide when you\r\n use SmartConnect, for instance when you issue commands or retrieve information about your devices.

1.2. Information we collect through online technology

\r\n

Analytics / Log Files - As is true of most online services, we gather certain information automatically and store it\r\n in log files. For example, when You access SmartConnect Portal our servers automatically record certain information\r\n that Your web browser sends. These server logs may include information such as Your operating system, browser type,\r\n URLs, Schneider device data, and other such information. We do not link this automatically collected data to\r\n personally identifiable information.

1.3. Information from the devices you have registered

\r\n

This is information relating to devices that are registered with your account. In the context of SmartConnect, the\r\n following information is processed.

\r\n

Please note that information is only processed if you choose to connect your UPS to the network and to use\r\n SmartConnect. It is possible to use the UPS in an offline manner, without getting the additional SmartConnect\r\n services.\r\n

If you have authorized us to collect pseudonymous telemetry data to improve our services, we will take steps to\r\n process this information separately from your device unique identifiers and your identity, to avoid linking these.

1.4. Data Collection by Google Analytics

\r\n When you visit our website, Google Analytics automatically collects certain information about your device, browser, \r\n and website usage. This data includes but is not limited to:\r\n

2. Why and how do we use your personal information?

\r\n

2.1. Operations

\r\n

We use the information to operate, maintain, enhance and provide all features of the Service, to provide the services\r\n and information that requested, and to provide support to users of the Service.

\r\n

SmartConnect data processing operations are:

\r\n

(a) data storage and reports; this is to perform the contract with the customer either as an individual user or as a\r\n legal person, in which case the contract performance is in the customer's and A.P.C.'s legitimate interests;

\r\n

(b) data analysis, information and notifications on the use of the device -A.P.C. processes personal information to\r\n provide the user with remote access to data generated by the device, analysis with other devices of the customer\r\n (UPS), as described in the T&C; this is to perform the contract with the customer either as an individual user or\r\n as a legal person, in which case the contract performance is in the customer's and A.P.C.'s legitimate interests;

(c) data combination -A.P.C. combines data from the customer's devices (UPS) with those from other customers' devices\r\n to provide the customer with comparison points against a baseline and with more personalized predictions and\r\n information, unless the customer opts out by ticking the appropriate box; this is to perform the contract with the\r\n customer either as an individual user or as a legal person, in which case the contract performance is in the\r\n customer's and A.P.C.'s legitimate interests;

(d) action on the device -SmartConnect enables customers to issue commands to their devices remotely. A.P.C. will\r\n also notify users about the availability of update packages (such as firmware updates) and will seek user's approval\r\n to install the update. These services require an affirmative action from the users and are based on the users' consent\r\n materialized by user-issued command or on the legitimate interest of the customer to control its devices.

2.2. Improvements

\r\n

We use information to understand and analyze the usage trends and preferences of our visitors and users, to improve\r\n the Service, and to develop new products, services, features, and functionality. This is based on our legitimate\r\n interests, provided that such processing shall not outweigh your rights and freedoms.

We use Google Analytics to gain insights into how visitors use our website, improve user experience, and optimize our content. \r\n The collected data helps us understand user preferences, potential interest in new product features and services, \r\n and make data-driven decisions to enhance our website's performance and relevance.\r\n

2.3. Communications and others

\r\n

We use personal information to contact You for administrative purposes, contract management, for customer service, to\r\n address intellectual property issues or complaints. Depending on the circumstances, this may be based on the execution\r\n of a contract with you, on our legitimate interest, on the legitimate interest of a third party, or for compliance\r\n with a legal obligation.

We keep information for as long as needed for these purposes, mainly we keep information to be able to provide the\r\n Service. We keep administrative and contact information for the duration of the contract and of our commercial\r\n relationship; and after as long as you maintain an interest in our activities. We also keep information that may be\r\n necessary to defend our rights as is legally required or in line with statutes of limitations.

Within SmartConnect, users are provided with an option to delete collected information concerning their devices.

3. How do we share your information and where is it processed?

\r\n

The SmartConnect site uses Hotjar for customer feedback. This functionality is\r\n optional,\r\n and You can choose not to use it. If You use Hotjar feedback functionality you can optionally provide Your email\r\n address. Hotjar captures screenshots, which may contain personal information. You may adjust your feedback to make\r\n sure it does not contain such personal information in screen captures. The Hotjar Privacy Policy is outlined\r\n here.\r\n We do not use Hotjar tracking and analytics features and will not do so without\r\n notice. You can opt-out of Hotjar tracking here.

The Service uses SendGrid as Email Service Provider. Notification emails on\r\n events occurring for your Schneider Electric Device will be processed through SendGrid. SendGrid does not store Your\r\n email address, unless it ends up in a blocked emails list. The SendGrid Privacy Policy is available\r\n here.

\r\n We use Google Analytics to gain insights into how visitors use our website, improve user experience, and optimize our content. \r\n The collected data helps us understand user preferences, potential interest in new product features and services, \r\n and make data-driven decisions to enhance our website's performance and relevance. You have the option to prevent Google Analytics \r\n from collecting your data by allowing only necessary cookies to be stored in our cookie consent banner. \r\n The Service also provides optional integrations with third party services as an alternative mechanism for delivering your Schneider \r\n Electric Device event notifications. Slack and Microsoft Teams \r\n are currently supported. Event notifications occurring for your Schneider Electric Device can be forwarded through to these service \r\n providers only if configured by the end-user. It is the responsibility of the end-user to manage their data with these providers as \r\n they are outside the scope of the services provided by Schneider Electric. \r\n The Slack privacy policy is available here. Personal information will be processed by A.P.C. affiliates and its suppliers, such as our cloud provider, involved\r\n in the provision of the SmartConnect services and in the performance of the data processing purposes described\r\n herein. A.P.C. being a global Company, the teams working on SmartConnect may have global or multi-country roles. These\r\n teams and our suppliers can be located anywhere in the world - including outside the European Union - in countries\r\n with different privacy standards than the country of location of our customers. In such cases, we take measures to\r\n ensure that personal information receives an adequate level of protection. A.P.C. has internal policies applied by its\r\n affiliates and concludes relevant contracts with its suppliers to ensure appropriate safeguards. To comply with\r\n requirements for transfers of personal information outside of the EU, A.P.C.'s parent company, Schneider Electric,\r\n has adopted Binding Corporate Rules (BCR). In addition, A.P.C. and its affiliates conclude Standard Contractual\r\n Clauses and relies on EU Commission's adequacy decisions. 4. How do we protect your information?

\r\n

We follow generally accepted industry standards to protect the information submitted to us, both during\r\n transmission\r\n and once we receive it. We maintain appropriate administrative, technical and physical safeguards to protect\r\n information against accidental or unlawful destruction, accidental loss, and unauthorized alteration. Please note that no method of transmission over the internet, or method of electronic storage, is 100% secure.\r\n Therefore, we cannot guarantee its absolute security.

\r\n The data collected through Google Analytics is retained for 14 months. Google publishes details about its data retention \r\n policies here.\r\n

5. How to exercise your choices and rights about your personal information?

\r\n

In order to exercise the data protection rights granted under applicable data protection law, such as the right to\r\n information, the right to access and rectification or to request erasure or in some jurisdictions the rights to\r\n restriction of personal information, objection and portability, individuals may:\r\n - access and edit their personal information and their choices, using their account settings\r\n - make a request at the contact details available within SmartConnect or at\r\n Global-Data-Privacy@schneider-electric.com\r\n - for additional suggestions, questions and requests, users may contact us as set forth in the “How to Contact Us”\r\n section. To ensure the security of your personal information, we may ask You provide other details to verify Your identity.\r\n

In its initial configuration, the SmartConnect Service will send a limited number of notifications (notifications\r\n concerning critical Device events) to the email address that you provided when signing up for a Schneider Electric\r\n account. You may configure this here and delete your\r\n email address.
